Charge dismissed against man accused of leaving scene of girlfriend's fatal accident

Published: Tuesday, November 23, 2010, 5:45 AM

A Baldwin Circuit judge last week dismissed a?charge against a man accused of leaving the scene of an accident which killed his girlfriend last year.

Alfred Lee Banks pleaded guilty to driving under the influence in the August 2009 incident.

Lisa Taylor of Spanish Fort died after being struck by a passing car on Stagecoach Road. According to the Baldwin County Sheriff’s Office, Banks, Taylor and Taylor’s son were driving back to their home off Stagecoach Road when the couple began to argue and Taylor exited Banks’ truck while it was still moving. The boy got out immediately after his mother and Banks drove away. Taylor was then stuck and killed by a sedan.

In its case, the state argued that the 54-year-old Banks, who now lives in Daphne, knew Taylor was injured when she exited the truck and he was bound by law to stop and help, according to Assistant District Attorney Brant Richerson.

"The state presented evidence in the trial, including eyewitness testimony" that supported both counts of the indictment, Richerson said Monday in an e-mail. "If Mr. Banks had stopped to render aid, he could have prevented Ms. Taylor’s death."

Defense attorney Pascal Bruijn said the testimony of Taylor’s son changed at trial, indicating that Banks ran over Taylor. Following the accident, the boy told investigators he believed the truck hit his mother. But in an audio recording of an interview by an investigator with the Sheriff’s Office, Bruijn said the boy indicated that Banks had no knowledge that Taylor was injured when he left the scene.

After the state’s evidence, Bruijn said he asked Judge Charles Partin for the dismissal on the basis that his client was not required to stop and render assistance because he was unaware Taylor had been injured.

"We didn’t even put on a defense," he said.

Richerson said the victim’s son testified to what he remembered happening. "It is the state’s position that it should have been obvious to Alfred Banks that Ms. Taylor was injured when she exited a moving vehicle that he was driving."

On the DUI charge, Banks received the maximum 12-month sentence along with a fine of $2,100 and court costs and fees, according to his attorney. He received credit for the 14 months he served awaiting trial, Bruijn said.

Williamson High School student faces capital murder charge in Domino's Pizza shooting

Published: Monday, November 15, 2010, 6:23 PM

MOBILE, Ala. -- Mobile police arrested an 18-year-old Williamson High School student Monday and charged him with capital murder in the fatal shooting of a Domino’s Pizza employee earlier this month, authorities said.

John Earl Dortch remained in Mobile County Metro Jail Monday afternoon without bail in the Nov. 4 shooting death of Russell Lee Allen, 21, who was shot during the robbery at Domino’s Pizza, 2912 Dauphin Island Parkway.

Dortch was scheduled for a court appearance Wednesday, according to jail records.

The robbery at Domino’s Pizza is one of dozens of robberies police are investigating that have occurred at businesses and homes across the city during the last couple of months.

Police arrested Dortch about 9:30 a.m. in the 900 block of Tanglewood Drive. Police said in a statement that a resident called police with a tip that led to Dortch’s arrest. He was home when police picked him up, Chief Michael T. Williams said.

“Dortch told the detective that he had been suspended since October for an incident on campus,” Williams said.

Mobile County public school officials on Monday afternoon could not find a record of Dortch, a senior at Williamson, being suspended, according to school system spokeswoman Nancy Pierce.

“This young man went into this store to rob it, and things went downhill, and he ended up shooting this kid and killing him,” Williams said.

“It’s unfortunate in a lot of ways,” Williams said. “We end up losing a 21-year-old who was out there working and trying to make a living for himself. And then on the other side, we lose an 18-year-old who will be charged with capital murder.

“This is a case where we have the right man,” he said.

Williams said the suspect identified the type of gun used in the shooting, and the police were attempting to retrieve it Monday afternoon.

“It’s my understanding that according to him, it was accidental,” Williams said. “He didn’t mean to shoot the guy. But sometimes that is what they tell us to try to get us to minimize it.”

Williams said police will try to determine if Dortch will be charged with any other robberies.

Domino’s Pizza officials offered a $10,000 reward for any information leading to an arrest in the robbery.

“The detectives and the people who put up the reward will have to determine how that’s to be resolved,” Williams said.

Teenager arrested on burglary charge; homeowner shot at him, say police

Published: Wednesday, November 03, 2010, 7:30 PM

MOBILE, Ala. -- Mobile police arrested a 17-year-old after a Wilmer Road homeowner shot at him as he was breaking in, officials said Wednesday in a news release.

Phillip Anthony Johnston remained in the Mobile County Metro Jail as of this evening, charged with two counts of first-degree burglary, according to jail records.

Police were called at 1:08 a.m. Tuesday for a burglary in progress in the 4400 block of Wilmer Road, officials said.

The homeowner saw Johnston attempting to come into the house through a window and a fired a shot at him, according to the release. The bullet didn’t hit the burglar, but he left the house, police said.

Johnston was found a few blocks away, police said.

Officers later determined that Johnston had burglarized a home in the 6800 block of Warrington Drive, entering with a gun and taking several items, police said. The Warrington Drive homeowner was not at home when that burglary occurred, officials said.
